Intersection Defective; Lawsuit Settled in Street Crossing Death
According to the Gilroy Dispatch, the city of Gilroy, California has settled a wrongful death lawsuit in connection with the death of a 5-year-old boy who was killed by a motorist while riding a scooter across the street. The lawsuit blamed the city for a "dangerous and defective" intersection that lacked a left-turn signal. The woman who was driving the truck that struck the young boy was criminally convicted and was sentenced to community service and probation, but no jail time. The child's family is receiving a settlement of $130,000. The Gilroy Dispatch reports that $30,000 of the settlement will be paid by the driver's insurance.
